PA LTC training requirement
Background
As the result of the federal Deficit Reduction Act of 2005, several states have implemented measures dealing with qualified partnership policies and long-term care insurance in general. One of the components stemming from the Deficit Reduction Act is Producer Training.
In Jan. 2008, the Pennsylvania Insurance Department issued Notice 2008-03 to lay out the basic requirements,
In Feb. 2011, the Insurance Department amended its Education and Training Regulation (31 Pa Code Chs. 39 and 39a) to further clarify the requirements.
Training requirement:
A producer who sells, solicits, or negotiates Qualified Partnership Policies (referred to as LTCP) must complete:
A one-hour training course on Medical Assistance Program (Medicaid) prior to any sale, solicitation or negotiation of a Qualified Partnership Policy,
In addition, any producer selling LTC insurance in the state will need to complete:
A one-time, eight-hour training course. The eight-hour training may include the one-hour LTCP course referenced above;
An ongoing, four-hour training course, to be completed once in every licensing period.
Deadline for compliance
Producers already holding an Accident & Health license (or who will be licensed in A&H by Apr. 1, 2011) and selling LTC:
must complete the 8 hours of LTC training by Apr. 1, 2012,
cannot sell LTC Partnership (LTCP) policies without first completing one hour of training on Medical Assistance Program (Medicaid); the hour can be included in the eight-hour course.
Producers who secure an A&H license after 04/01/11 must complete the eight-hour training prior to selling LTC and LTCP policies.
Comments:
1) This requirement is "training," not Continuing Education (CE). However, as long as the course has been filed and approved for CE, the credits will count toward CE completion as well.
2) A burden is placed on insurers to verify that producers have completed the appropriate course in compliance with the requirement. Producers should retain their completion certificates to demonstrate compliance.
3) If you completed the training to comply with Notice 2008-03, a new notice should be published by the Insurance Department after Apr. 1, 2011 to confirm prior approved courses that meet the new requirement.
